IN SOLIDARITY WITH A FREE PRESS: SOME MORE BLASPHEMOUS CARTOONS

Defending free speech and free press rights, which typically means defending the right to disseminate the very ideas society finds most repellent, has been one of my principal passions for the last 20 years: previously as a lawyer and now as a journalist. So I consider it positive when large numbers of people loudly invoke this principle, as has been happening over the last 48 hours in response to the horrific attack on Charlie Hebdo in Paris.

Usually, defending free speech rights is much more of a lonely task. For instance, the day before the Paris murders, I wrote an article about multiple cases where Muslims are being prosecuted and even imprisoned by western governments for their online political speech – assaults that have provoked relatively little protest, including from those free speech champions who have been so vocal this week.

 

I’ve previously covered cases where Muslims were imprisoned for many years in the U.S. for things like translating and posting “extremist” videosto the internet, writing scholarly articles in defense of Palestinian groups and expressing harsh criticism of Israel, and even including a Hezbollah channel in a cable package. That’s all well beyond the numerous cases ofjobs being lost or careers destroyed for expressing criticism of Israel or (much more dangerously and rarely) Judaism. I’m hoping this week’s celebration of free speech values will generate widespread opposition to all of these long-standing and growing infringements of core political rights in the west, not just some.

B6yh7dfIEAAC88hCentral to free speech activism has always been the distinction between defending the right to disseminate Idea X and agreeing with Idea X, one which only the most simple-minded among us are incapable of comprehending. One defends the right to express repellent ideas while being able to condemn the idea itself. There is no remote contradiction in that: the ACLU vigorously defends the right of neo-Nazis to march through a community filled with Holocaust survivors in Skokie, Illinois, but does not join the march; they instead vocally condemn the targeted ideas as grotesque while defending the right to express them.

But this week’s defense of free speech rights was so spirited that it gave rise to a brand new principle: to defend free speech, one not only defends the right to disseminate the speech, but embraces the content of the speech itself. Numerous writers thus demanded: to show “solidarity” with the murdered cartoonists, one should not merely condemn the attacks and defend the right of the cartoonists to publish, but should publish and even celebrate those cartoons. “The best response to Charlie Hebdo attack,”announced Slate’s editor Jacob Weisberg, “is to escalate blasphemous satire.”

Some of the cartoons published by Charlie Hebdo were not just offensive but bigoted, such as the one mocking the African sex slaves of Boko Haram as welfare queens (left). Others went far beyond maligning violence by extremists acting in the name of Islam, or even merely depicting Mohammed with degrading imagery (above, right), and instead contained a stream of mockery toward Muslims generally, who in France are not remotely powerful but are largely a marginalized and targeted immigrant population.

But no matter. Their cartoons were noble and should be celebrated – not just on free speech grounds but for their content. In a column entitled “The Blasphemy We Need,” The New York Times‘ Ross Douthat argued that “the right to blaspheme (and otherwise give offense) is essential to the liberal order” and “that kind of blasphemy [that provokes violence] is precisely the kind that needs to be defended, because it’s the kind that clearly serves a free society’s greater good.” New York Magazine‘s Jonathan Chait actually proclaimed that “one cannot defend the right [to blaspheme] without defending the practice.” Vox’s Matt Yglesias had a much more nuanced view but nonetheless concluded that “to blaspheme the Prophet transforms the publication of these cartoons from a pointless act to a courageous and even necessary one, while the observation that the world would do well without such provocations becomes a form of appeasement.”

To comport with this new principle for how one shows solidarity with free speech rights and a vibrant free press, we’re publishing some blasphemous and otherwise offensive cartoons about religion and their adherents:

Is it time for me to be celebrated for my brave and noble defense of free speech rights? Have I struck a potent blow for political liberty and demonstrated solidarity with free journalism by publishing blasphemous cartoons? If, as Salman Rushdie said, it’s vital that all religions be subjected to “fearless disrespect,” have I done my part to uphold western values?

When I first began to see these demands to publish these anti-Muslim cartoons, the cynic in me thought perhaps this was really just about sanctioning some types of offensive speech against some religions and their adherents, while shielding more favored groups. In particular, the west has spent years bombing, invading and occupying Muslim countries and killing, torturing and lawlessly imprisoning innocent Muslims, and anti-Muslim speech has been a vital driver in sustaining support for those policies.

So it’s the opposite of surprising to see large numbers of westerners celebrating anti-Muslim cartoons – not on free speech grounds but due to approval of the content. Defending free speech is always easy when you like the content of the ideas being targeted, or aren’t part of (or actively dislike) the group being maligned.

Indeed, it is self-evident that if a writer who specialized in overtly anti-black or anti-Semitic screeds had been murdered for their ideas, there would be no widespread calls to republish their trash in “solidarity” with their free speech rights. In fact, Douthat, Chait and Yglesias all took pains to expressly note that they were only calling for publication of such offensive ideas in the limited case where violence is threatened or perpetrated in response (by which they meant in practice, so far as I can tell: anti-Islam speech). Douthat even used italics to emphasize how limited his defense of blasphemy was: “that kind of blasphemy is precisely the kind that needs to be defended.”

One should acknowledge a valid point contained within the Douthat/Chait/Yglesias argument: when media outlets refrain from publishing material out of fear (rather than a desire to avoid publishing gratuitously offensive material), as several of the west’s leading outletsadmitted doing with these cartoons, that is genuinely troubling, an actual threat to a free press. But there are all kinds of pernicious taboos in the west that result in self-censorship or compelled suppression of political ideas, from prosecution and imprisonment to career destruction: why is violence by Muslims the most menacing one? (I’m not here talking about the question of whether media outlets should publish the cartoons because they’re newsworthy; my focus is on the demand they be published positively, with approval, as “solidarity”).

When we originally discussed publishing this article to make these points, our intention was to commission two or three cartoonists to create cartoons that mock Judaism and malign sacred figures to Jews the way Charlie Hebdo did to Muslims. But that idea was thwarted by the fact that no mainstream western cartoonist would dare put their name on an anti-Jewish cartoon, even if done for satire purposes, because doing so would instantly and permanently destroy their career, at least. Anti-Islam and anti-Muslim commentary (and cartoons) are a dime a dozen in western media outlets; the taboo that is at least as strong, if not more so, are anti-Jewish images and words. Why aren’t Douthat, Chait, Yglesias and their like-minded free speech crusaders calling for publication of anti-Semitic material in solidarity, or as a means of standing up to this repression? Yes, it’s true that outlets like The New York Times will in rare instances publishsuch depictions, but only to document hateful bigotry and condemn it – not to publish it in “solidarity” or because it deserves a serious and respectful airing.

With all due respect to the great cartoonist Ann Telnaes, it is simply not the case that Charlie Hebdo “were equal opportunity offenders.” Like Bill Maher, Sam Harris and other anti-Islam obsessives, mocking Judaism, Jews and/or Israel is something they will rarely (if ever) do. If forced, they can point to rare and isolated cases where they uttered some criticism of Judaism or Jews, but the vast bulk of their attacks are reserved for Islam and Muslims, not Judaism and Jews. Parody, free speech and secular atheism are the pretexts; anti-Muslim messaging is the primary goal and the outcome. And this messaging – this special affection for offensive anti-Islam speech – just so happens to coincide with, to feed, the militaristic foreign policy agenda of their governments and culture.

To see how true that is, consider the fact that Charlie Hebdo – the “equal opportunity” offenders and defenders of all types of offensive speech –fired one of their writers in 2009 for writing a sentence some said was anti-Semitic (the writer was then charged with a hate crime offense, and won a judgment against the magazine for unfair termination). Does that sound like “equal opportunity” offending?

Nor is it the case that threatening violence in response to offensive ideas is the exclusive province of extremists claiming to act in the name of Islam. Terrence McNally’s 1998 play “Corpus Christi,” depicting Jesus as gay, wasrepeatedly cancelled by theaters due to bomb threats. Larry Flynt wasparalyzed by an evangelical white supremacist who objected to Hustler‘s pornographic depiction of inter-racial couples. The Dixie Chicks weredeluged with death threats and needed massive security after they publicly criticized George Bush for the Iraq War, which finally forced them to apologize out of fear. Violence spurred by Jewish and Christian fanaticism is legion, from abortion doctors being murdered to gay bars being bombed to a 45-year-old brutal occupation of the West Bank and Gaza due in part to the religious belief (common in both the U.S. and Israel) that God decreed they shall own all the land. And that’s all independent of the systematic state violence in the west sustained, at least in part, by religioussectarianism.

The New York Times‘ David Brooks today claims that anti-Christian bias is so widespread in America – which has never elected a non-Christian president – that “the University of Illinois fired a professor who taught the Roman Catholic view on homosexuality.” He forgot to mention that the very same university just terminated its tenure contract with Professor Steven Salaita over tweets he posted during the Israeli attack on Gaza that the university judged to be excessively vituperative of Jewish leaders, and that the journalist Chris Hedges was just disinvited to speak at the University of Pennsylvania for the Thought Crime of drawing similarities between Israel and ISIS.

That is a real taboo – a repressed idea – as powerful and absolute as any in the United States, so much so that Brooks won’t even acknowledge its existence. It’s certainly more of a taboo in the U.S. than criticizing Muslims and Islam, criticism which is so frequently heard in mainstream circlesincluding the U.S. Congress – that one barely notices it any more.

This underscores the key point: there are all sorts of ways ideas and viewpoints are suppressed in the west. When those demanding publication of these anti-Islam cartoons start demanding the affirmative publication ofthose ideas as well, I’ll believe the sincerity of their very selective application of free speech principles. One can defend free speech without having to publish, let alone embrace, the offensive ideas being targeted. But if that’s not the case, let’s have equal application of this new principle.

 

My Breaking Point


Everyone has their breaking point for hate speech and racism.  Mine came when I watched the video you can find here, where what started out to be a “decent” interview between a Fox reporter, Megyn Kelly, and a representative of the Media Research Center and Council of American-Islamic Relations ended with the Fox reporter shouting ‘that’s way out of line, that’s way out of line’  at the CAIR representative as if to imply he had no businesss making the assertion that more abortion clinic personnel  have been killed by members of the Christian right who protested what is  a legal right women have to abortion than people who’ve been killed by Muslims protesting depictions of the Last Messenger and Prophet.   Evidently that fact doesn’t fit into Fox News’ ideas of domestic terrorism and who the adherents of terrorism are especially if they are white Christians and not brown skinned bearded, covered and menacing Muslims.

Glen Greenwald’s breaking point must have come when he read a New York Times editorial by one Ross Douthat a rather nasty Islamophobe who has been featured in the pages of Miscellany101 before here.  Douthat’s piece put forth the premise Muslims can intimidate artists who live by poetic license into not offending Muslim sensibilities but law abiding Christians who supposedly don’t engage in the same polemic are  offended by artists who are not afraid of them nor have any respect for Christian religious beliefs.  Greenwald pretty much slams the door on Douthat and by extension the visibly upset FoxNews reporter’s argument thusly:

It looks like Ross Douthat picked the wrong month to try to pretend that threat-induced censorship is a uniquely Islamic practice.  Corpus Christi is the same play that was scheduled and then canceled (and then re-scheduled) by the Manhattan Theater Club back in 1998 as a result of “anonymous telephone threats to burn down the theater, kill the staff, and ‘exterminate’ McNally.”  Both back then and now, leading the protests (though not the threats) was the Catholic League, denouncing the play as “blasphemous hate speech.”

I abhor the threats of violence coming from fanatical Muslims over the expression of ideas they find offensive, as well as the cowardly institutions which acquiesce to the accompanying demands for censorship.  I’ve vigorously condemned efforts to haul anti-Muslim polemicists before Canadian and European “human rights” (i.e., censorship) tribunals.  But the very idea that such conduct is remotely unique to Muslims is delusional, the by-product of Douthat’s ongoing use of his New York Times column for his anti-Muslim crusade and sectarian religious promotion.

The various forms of religious-based, intimidation-driven censorship and taboo ideas in the U.S. — what Douthat claims are non-existent except when it involves Muslims — are too numerous to chronicle.  One has to be deeply ignorant, deeply dishonest or consumed with petulant self-victimization and anti-Muslim bigotry to pretend they don’t exist.  I opt (primarily) for the latter explanation in Douthat’s case.

As Balloon-Juice’s DougJ notes, everyone from Phil Donahue and Ashliegh Banfield to Bill Maher and Sinead O’Connor can tell you about that first-hand.  As can the cable television news reporters who were banned by their corporate executives from running stories that reflected negatively on Bush and the war.  When he was Mayor of New York, Rudy Giuliani was fixated on using the power of his office to censor art that offended his Catholic sensibilities.  The Bush administration banned mainstream Muslim scholars even from entering the U.S. to teach.  The Dixie Chicks were deluged with death threats for daring to criticize the Leader, forcing them to apologize out of fear for their lives.  Campaigns to deny tenure to academicians, or appointments to politicial officials, who deviate from Israel orthodoxy are common and effective.  Responding to religious outrage, a Congressional investigation was formally launched and huge fines issued all because Janet Jackson’s breast was displayed for a couple of seconds on television.

All that’s to say nothing of the endless examples of religious-motivated violence by Christian and Jewish extremists designed to intimidate and suppress ideas offensive to their religious dogma (I’m also pretty sure the people doing this and this are not Muslim).  And, contrary to Douthat’s misleading suggestion, hate speech laws have been used for censorious purposes far beyond punishing speech offensive to Muslims — including, for instance, by Christian groups invoking such laws to demand the banning of plays they dislike.

It’s nice that The New York Times hired a columnist devoted to defending his Church and promoting his religious sectarian conflicts without any response from the target of his bitter tribalistic encyclicals.  Can one even conceive of having a Muslim NYT columnist who routinely disparages and rails against Christians and Jews this way?  To ask the question is to answer it, and by itself gives the lie to Douthat’s typically right-wing need to portray his own majoritarian group as the profoundly oppressed victim at the hands of the small, marginalized, persecuted group which actually has no power (it’s so unfair how Muslims always get their way in the U.S.).  But whatever else is true, there ought to be a minimum standard of factual accuracy required for these columns.  The notion that censorship is exercised only on behalf of Muslims falls far short of that standard.

(1) Several people are insisting that the problem of violence and threats by Muslims is far greater than, and thus not comparable to, those posed by Christians and Jews.  This is just the same form of triabalistic, my-side-is-always-better blindness afflicting Douthat.  Who could possibly look at the U.S. and conclude that brutal, inhumane, politically-motivated, designed-to-intimidate violence is a particular problem among Muslims, or that Muslims receive special, unfairly favorable treatment as a result of their intimidation?  Do you mean except for the tens of thousands of Muslims whom the U.S. has imprisoned without charges for years, and the hundreds of thousands our wars and invasions and bombings have killed this decade alone, and the ones from around the world subjected to racial and ethnic profiling, and the ones we’ve tortured and shot up at checkpoints and are targeting for state-sponsored assassination?

(2) There’s no question that violence or threatened violence by Islamic radicals against authors, cartoonists and the like is a serious problem.  But (a) simply click on the links above — or talk to workers in abortion clinics about the climate in which they work — and try to justify how you can, with a straight face, claim it’s not very pervasive among extremists and fanatics generally, and (b) avoid exaggerating the problem.  The group that threatened the South Park creators is a tiny, fringe group founded by a former right-wing Jewish-American settler in the West Bank who converted to Islam and spends most of his time harrassing American Muslims (the former “James Cohen”; h/t Archtype); they’re about as representative of Muslims generally as Fred Phelps and these people are representative of Christians.  Moreover, numerous blogs displayed the Mohammed cartoons and plan to do so again; the notion that the Western World is cowering in abject fear from Muslim intimidation is absurdly overblown.

(3) Sarah Palin recently defended the Rev. Franklin Graham’s statement that Islam is “a very evil and wicked religion.”  That barely caused a ripple of controversy.  Imagine if a leading political figure had said anything remotely similar about Christianity or Judaism.  The claim that Muslims receive some sort of special protection or sensitivity is the opposite of reality.

I might add everywhere you see The New York Times and or Ross Douthat in Greenwald’s piece above, you can safely insert FoxNews and Megyn Kelly, or any other corporate media type and their corresponding lackey/reporter….the rhetoric is essentially the same and equally perverse.  If you want to really get a flavor for Greenwald’s piece read it in its entirety here.

What is common about these two media encounters, mine and Greenwald’s is how it appears media wants to inflame public passions against a group of people who are 0.00067% of the Muslim population (548 members of Revolution Muslim out of an estimated population of 6 million Muslims)  of the US in such a way as to imply they can possibly limit or even do away with the freedoms of speech we hold so dearly when it has been the government’s response to this minuscule number that  poses a greater threat to that freedom than anything the Revolution Muslim can conjure.   Such is the rhetoric which drives media and government ever closer to the precipice of destroying the social order in a way no amount of terror, Islamic, foreign, domestic, militia driven or otherwise could ever do and yet the general public seems alright with that notion that freedom and liberty are ok to forfeit or lose at the expense of persecuting minorities, the opposition, but certainly for now Muslims.  It is a notion we have embraced to readily in our past and it’s time to forgo it now.

Fellatio as policy in the Middle East


That’s what Thomas Friedman gave as the reason for our invasion of countries in the Middle East in his much ballyhooed interview with Charlie Rose several years ago.  (The clip above.)  It seems however that Friedman either forgot his bravado laced interview or considers it insignificant when writing his latest Mid East pronouncements, which appear here.   In this latest tripe Friedman passes for an editorial (can you believe he gets P-A-I-D for writing this stuff?!) Friedman talks about the “narrative” and describes it thusly

The Narrative is the cocktail of half-truths, propaganda and outright lies about America that have taken hold in the Arab-Muslim world since 9/11. Propagated by jihadist Web sites, mosque preachers, Arab intellectuals, satellite news stations and books — and tacitly endorsed by some Arab regimes — this narrative posits that America has declared war on Islam, as part of a grand “American-Crusader-Zionist conspiracy” to keep Muslims down.

Friedman forgot to mention himself as one who promotes the “narrative”; even by his own accounts we invaded Muslim countries and killed scores of innocence not for any grand or noble political designs for us, Americans, or for them, the citizens of those countries, but rather we reaped all of that havoc ‘because we could’ and to get them to Suck. On. This. That mentality is what drove the pornographic rage that we’ve only seen snippets of that took place in Abu Ghraib.  (I’m sure all the citizens of Iraq, and some other Muslim countries too, have heard all of the stories our democracy has said we here in America aren’t eligible to hear or know about.)  Friedman mentions Abu Ghraib, but only in passing, in the midst of  extolling all the good things American soldiers did or are doing in Iraq as occupiers mind you of a country that initially was no threat to the vital interests of the US or her allies.  While chiding “jihadists” for ignoring the latter, Friedman did himself and his article a disservice but doing the same with the former.

As usual, Glen Greenwald does a pretty good job of dismantling the Friedman fantasy/hypocrisy.  Among his zingers to Friedman’s piece are lines like these

And note the morality on display here:  Hasan attacks soldiers on a military base of a country that has spent the last decade screaming to the world that “we’re at war!!,” and that’s a deranged and evil act, while Friedman cheers for an unprovoked war that killed hundreds of thousands of innocent civilians and displaced millions more — all justified by sick power fantasies, lame Mafia dialogue and cravings more appropriate for a porno film than a civilized foreign policy — and he’s the arbiter of Western reason and sanity.

That’s only one of several well placed punches to Friedman’s devilishly childish arguments in his latest op-ed.  Steven Walt of the infamous Walt-Mearsheimer duo which brought the world the book, The Israel Lobby and US Foreign Policy, and brought upon themselves an undeserved ignominy, weighed in on Friedman’s article as well with less than sterling results, in my opinion, because of his emphasis on “numbers” of casualties amassed to make the case for why “they” hate us. The comments section of his article is why his article lacks the strength of moral certainty to oppose Friedman’s op-ed.  Simply put people don’t care about the whys and wherefores these days and using that argument about why Muslims hate us without mentioning that we launched a war of aggression against them based on lies that our government made and upheld in order to invade and total decimate their culture, and that we continue to justify our occupation based on these debunked lies is disingenuous, in this writer’s estimation.   Walt is an academic so perhaps that’s why he relied so heavily on numbers in his “refutation” of Friedman’s article, but in so doing he let Friedman off the hook for his, Friedman’s, obscene insistence for war and his cheerleading for it when he knew ostensibly that he was lying.  If Walt had simply said that, any claim to legitimacy on the part of Friedman, would have been irrevocably lost.

Friedman is an apologist for wars of aggression and he wants the victims of such wars to engage him in semantic pedantry which is why he issues this weak call out  at the end of his article.   It’s a waste of time for him to issue it and even more a waste of time for others to answer it.  What Mr. Friedman needs to be reminded of is the importance of ‘the rule of law’, something he nor any of his supporters really had a handle on for the last 10 years. Friedman is the newspaper world’s hate radio pundits; not much substance and  a lot of hot air.  His bias and hatred for the people he generally writes about borders on the sophomoric, not at all worthy of the New York Times, or if you insist that it is, then both are not news that’s fit to be printed.  May I suggest citizenship journalism instead?

Historical Revisionism-Changing the meaning of Words


wordsPeople are fond of saying words have meaning, and indeed that’s true.  Perhaps this notion of changing the use of words to serve a political purpose is something that’s been going on in America for some time, I don’t know, but with the onset of the war on terror, the politicization of words, applying them or changing them to mean something else and with a different value has been stark.  The first instance that comes to mind is the use of the word “insurgent” in place of the word “resistance fighter” because the latter signified opposition to American imperialism which in all of its form and substance is intended to be benign and beneficial for the people on whom it is imposed while the former was meant to signify an illegal opposition to authority, in this case ours.  Of course that is a subjective application of words, with a definite western leaning lexicography and Americans eventually applied  the term to all who fought against American and Iraqi forces on the ground which by default meant they were enemies of the State.  It was a nifty trick which seeped into our consciousness and made it possible for us to feel good about ourselves while fueling a rage for a people we went both to liberate as well as fight.

Now comes word of the change from the use of the word “torture” to “enhanced interrogation”. In an attempt to deny history the chance to note the United States as a country that used torture, which is in and of itself criminal,  many in media are now using words that don’t signify American culpability in criminal behavior.  Glen Greenwald does an excellent job dismantling this bizarre slow evolution from an America that used torture, and lied, to forge a new Iraq to a country that “interrogated: suspects,  and I strongly recommend you read his piece here and here.  That the media seems to be in lock step with this idea that torture doesn’t apply to what America does, but only to what our enemies do is nothing less than historical revisionism that puts the proponents of that idea on the same level as those who question the Holocaust or those who assert present day America has the right to its exceptionalism; meaning the United States is somehow  “above” or an “exception” to the law, even those laws which it drafts and codifies.  The people who accept  and pass on this change in the meaning of torture versus interrogation have made a mockery of themselves and the institutions they work for, ignoring all the treaties and laws the country has signed which obligates it to follow as well as  prosecute those among us who break these laws.   Any claim America has to moral relevancy or legitimacy is diminished each time we change the meaning of words through omission or otherwise to further political agendas that are not at all based in fact.  It is only a matter of time, as America becomes increasingly engaged in wars of aggression, before the same rationale and language will be used by America’s enemies  against us as they straddle and cross lines of legal and illegal behavior.
